DA wants jail time for students in San Jose State bullying case
SAN JOSE
A district attorney in Northern California says he wants three former San Jose State University students who are white – one of them from Clovis – to go to jail for forcing a bike lock around a black roommate’s neck.
KTVU-TV reports that the young men were each found guilty of misdemeanor battery but not convicted of hate crimes. The jury deadlocked on that charge for Colin Warren of Woodacre and Logan Beaschler of Bakersfield and found Joseph “Brett” Bomgardner of Clovis, now 21, not guilty.
Santa Clara County District Attorney Jeff Rosen says he won’t retry them on the hate crime charges. But he says he is asking Superior Court Judge Thang Barrett to sentence each man to four months in jail and 50 hours of community service.
Donald “DJ” Williams Jr. has sued the university. The white students were expelled.
The hazing during the fall 2013 semester sparked campus protests, an internal investigation and the creation of a campus task force on racial discrimination.
Witnesses testified during the more than two-week trial that the abuse of Williams, who was 17 at the time, included the two bike lock incidents, as well as calling him by the nicknames referring to America’s history of slavery, writing a form of the “N-word” on a whiteboard and displaying the Confederate flag.
Attorneys for the defendants, who were all San Jose State freshmen at the time of the incidents, argued that their clients simply took a “prank war” too far because they were “immature, insensitive and stupid.”
